Website Terms of Use
Effective October 1, 2026.
These Website Terms of Use apply to the public websites of Broadsight Technology Corporation (“Broadsight,” “we,” “us” or “our”), a British Columbia corporation. The “Websites” are the same properties our Privacy Policy describes: broadsight.ca and www.broadsight.ca, the legacy broadsighttracker.ca addresses, communications.broadsight.ca, our knowledge base and resource content, forms hosted for us by HubSpot, and our purchase and sign-up page at broadsight.square.site. By using the Websites, you agree to these Terms.
These Terms cover the Websites only. The Broadsight platform, including app.broadsight.ca and its AI features, is provided to organizations under Broadsight’s Cloud Service Agreement or another signed agreement, which governs that use. If anything on the Websites differs from a signed agreement, the signed agreement governs. A purchase made through our sign-up page is governed by the agreement presented at the time of purchase.
1. Using the Websites
The Websites are intended for organizations and the people who work for them. They are not directed to children.
You may use the Websites for lawful business and informational purposes. You may not use them to interfere with their operation or security, attempt to gain unauthorized access to systems or information, introduce malicious code, use them unlawfully, or infringe the rights of Broadsight or others.
Ordinary search-engine indexing is permitted. Other automated collection or reproduction of substantial Website content requires our permission, unless the law allows it.
2. Website and product information
The Websites describe Broadsight, our products and our services, and we update them as our products and business change. Descriptions of features, pricing, implementation and other service details do not form or amend a customer agreement.
Screenshots, interactive demonstrations and examples use sample or fictional information, including fictional organizations, to show how Broadsight works. AI-generated responses shown in demonstrations are illustrative, not outputs from any customer’s workspace. As our Privacy Policy explains, AI output can be incomplete or inaccurate, and Broadsight’s AI features prepare drafts and summaries for a person to review before they are relied on.
3. Beta programs and upcoming features
We may make features available before general release, such as the Chippy beta. For organizations already using Broadsight, beta features are provided under their agreement with us. If you join a beta through the Websites, any participation terms provided when you join apply in addition to these Terms.
Beta features may change, be limited or be withdrawn at any time, and may not become part of a future product.
References to planned, upcoming or in-development features describe our current intentions. They are not a commitment to deliver a feature or to deliver it by a particular date, and should not be relied on when making a purchasing decision.
4. Intellectual property
The Websites and their content, design, software, graphics, trademarks and other materials are owned by or licensed to Broadsight and are protected by intellectual property laws.
You may view and use publicly available Website content for informational and internal evaluation purposes. You may not reproduce, republish, distribute or commercially exploit substantial Website content, or use Broadsight’s name, logos or branding in a way that suggests our endorsement or affiliation, without our permission or another lawful basis.
5. Feedback and suggestions
If you send us ideas, suggestions or other feedback about Broadsight, including through our help and feedback forms or a beta program, you agree that we may use it to improve our products and services without obligation or payment to you. Any personal information you include is handled as our Privacy Policy describes.
6. Third-party services and links
The Websites use services provided by third parties, including Google Analytics and Google Tag Manager, Google Ads conversion tracking, the LinkedIn Insight Tag, HubSpot (for forms and our cookie banner), WordPress.com and Jetpack, Vimeo and Loom video, and Gravatar. Our Privacy Policy describes what each one does, and our cookie banner lets you accept or decline non-essential cookies.
Third-party services and linked websites operate under their own terms and privacy practices. We are not responsible for the content, availability or practices of services and websites we do not control.
7. Privacy and what not to send us
Our collection and handling of personal information through the Websites is described in our Privacy Policy, which forms part of these Terms.
Please send only what your enquiry needs. Do not submit patient, medical or health information, financial-account details, government identification numbers or other highly sensitive information, or confidential information about your organization’s customers, through our contact, demonstration, help or beta forms.
8. Website availability
We may change, suspend or discontinue any part of the Websites at any time. The Websites are not covered by any service level or availability commitment that applies to the Broadsight platform under a customer agreement.
9. Disclaimer
We make reasonable efforts to keep the Websites accurate and current. However, the Websites and their content are provided “as is” and “as available,” for general information only. To the extent permitted by law, Broadsight makes no warranties or representations about the Websites, including that they will be uninterrupted, error-free or free of harmful components, or that their content is complete or suitable for a particular purpose.
Website content is not legal, privacy, security or communications advice, and does not replace the terms of a customer agreement.
10. Limitation of liability
To the extent permitted by law, Broadsight and its directors, officers, employees and service providers are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to your use of, or inability to use, the Websites or any third-party service or website linked from them.
This section does not apply to the Broadsight platform, which is covered by the applicable customer agreement. Nothing in these Terms limits any liability that cannot lawfully be limited.
11. Governing law and where information is processed
These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. The courts of British Columbia, and the Federal Court of Canada for matters within its jurisdiction, have exclusive jurisdiction over any dispute about these Terms or the Websites, except where the law of your place of residence provides otherwise.
Broadsight is based in Canada, and production customer data in the Broadsight platform is hosted in Canada. Some of the service providers that support the Websites process information outside Canada, including in the United States, as described in our Privacy Policy.
12. General
If any part of these Terms is found to be unenforceable, the rest remains in effect. If we do not enforce a provision, we have not waived it. These Terms, together with our Privacy Policy and any beta participation terms that apply to you, are the entire agreement between you and Broadsight about the Websites.
We may update these Terms when the Websites, our practices or the law change. The effective date above shows the current version. Where a change is material, we will post a prominent notice on the Websites before it takes effect. Continuing to use the Websites after a change takes effect means you accept the updated Terms.
